Terms of Use TicketwaveSU

These Terms of Use (hereinafter “Terms”) describe the rules and regulations for using the TicketwaveSU platform and all related services. By using our website, mobile application, or other services (collectively “the Service”), you agree to these Terms.

 

Article 1: Definitions

1.1 Definitions:

General Terms and Conditions: These terms and conditions of TicketWaveSu.

Client: The party that places a reservation for tickets with TicketWaveSu.

Ticketshop: The online platform of TicketWaveSu for the sale and management of tickets.

Admission Fees: The price of tickets excluding extra costs such as reservation fees.

Event: A public or private happening, such as a concert or sporting event.

Venue: The location where the Event is held.

Organizer: The party responsible for the organization of the Event.

Agreement: The agreement between the Organizer and the Client for the provision of services via TicketWaveSu.

Ticket: The admission ticket for an Event, sold through the Ticketshop.

TicketWaveSu: Located at Van der Woudendijk 4, 2496 XS The Hague, Netherlands.

1.2 Applicability

These General Terms and Conditions apply to all services, offers, and reservations made through TicketWaveSu. Deviations are only possible in writing.

1.3 Precedence

The terms and conditions of the Organizer and Venue Holder also apply, but in case of conflicts, these General Terms and Conditions of TicketWaveSu shall prevail.

1.4 Mediation

TicketWaveSu is solely an intermediary between the Client and the Organizer and is not responsible for the Event itself.

Article 2: Information

2.1 Non-Binding Information

All information regarding events and tickets Availability  provided by Ticketwavesu is non-binding and subject to change.

Article 3: Payments

3.1 Execution

Payment of the Admission Fees and other costs is made through TicketWaveSu.

3.2 Destination

Payments are made to the bank account of TicketWaveSu, based on authorization from the Organizer.

3.3 Payout

Payouts to the Event Organizer are processed weekly every Monday, unless a separate agreement has been formally confirmed.

Organizers can monitor all ticket sales and payout statuses directly within their personalized dashboard.

Article 4: Formation of the Agreement

4.1 Acceptance

The Agreement is formed as soon as TicketWaveSu has received the payment. Confirmation will follow by email.

4.2 Failed Payment

In the event of failed payments, the Client will receive notification by email or post.

Article 5: Tickets

5.1 Ownership and Use

Tickets remain the property of the Organizer and may not, without written permission:

Be resold.
Be offered commercially or used in advertising expressions.

Article 6: Liability

6.1 Organizational Responsibility

TicketWaveSu is not responsible for the organization, quality, or running of the Event or the Venue.

6.2 Refunds

Refunds in case of cancellation are handled by the Organizer, not by TicketWaveSu.

6.3 Damage Limitation

TicketWaveSu will never reimburse more than the Admission Fees and is not responsible for extra costs (e.g., travel or accommodation costs).

6.4 Personal Damage

TicketWaveSu is not liable for damage, loss, or theft during the Event.

6.5 Lost Tickets

TicketWaveSu is not responsible for lost Tickets.

6.6 External Purchase

TicketWaveSu accepts no liability for Tickets purchased outside the Ticketshop.

6.7 Contractual Relationship

The transaction takes place between the Client and the Organizer; TicketWaveSu is not a contracting party to the purchase-sale agreement.

 

Article 7: Intellectual Property

7.1 TicketWaveSu Ownership

The intellectual property rights of TicketWaveSu remain with TicketWaveSu. Use without written permission is not allowed.

7.2 Third-Party Ownership

The intellectual property rights of Events and Venues belong to the Organizer or original right holders.

 

Article 8: Rules of Conduct

8.1 Compliance

The Client must comply with the rules of conduct set by the Organizer and the Venue Holder.

8.2 Refusal of Entry

Entry may be refused if Tickets were not obtained through authorized sales channels.

8.3 Late Arrival

Visitors who arrive late may be denied access.

8.4 Image Rights

The Organizer may make image and sound recordings; the Client automatically consents to this.

Article 9: Rates

9.1 Costs for Organizer

TicketWaveSu charges the Organizer  for:

  1. Per Ticket sold.
  2. Use of the Ticketshop and systems.
  3. Bank transfer services.
  4. Organizer in the Netherland : € 1,49 inclusive btw.
  5. Organizer in Suriname : SRD 20

9.2 Mention of Rates

Rates are stated on the TicketWaveSu Website or in the Agreement.

9.3 VAT

All rates are inclusive of VAT.

9.4 Rate Adjustment

TicketWaveSu may adjust rates temporarily.

9.5 Liability for External Costs

Extra costs incurred by the Organizer or Client cannot be passed on to TicketWaveSu.

9.6 Payment of Rates

Payment of rates is carried out as described in Article 3.3.

9.7 Exemption in Case of Refund

Even in the case of ticket refunds, the rates of TicketWaveSu remain due.

9.8 Refund Costs

For refunds to users, TicketWaveSu charges €1.49 per Ticket in The Netherlands and SRD 20 in Suriname, whereby only the Admission Fees are refunded (excluding service and transaction costs).

Article 10: Ticketshop

10.1 Facilitation

TicketWaveSu facilitates the Ticketshop, but the agreement for ticket purchase is between the Client and the Organizer.

10.2 Client’s Obligation to Provide Information

The Client must provide correct information when placing the order.

10.3 Adjustments

The Client can make adjustments within the ordering process.

10.4 Additional Terms

Additional terms and conditions from the Organizer may apply.

10.5 Discount Promotions

Discount coupons and vouchers are only valid if explicitly indicated during the ordering procedure.

 

Article 11: Additional Provisions

11.1 Severability

If a provision is null and void, the remaining provisions remain valid.

11.2 Changes to General Terms and Conditions

Changes to the General Terms and Conditions can only be made in writing.

11.3 Complaints Procedure

Complaints must be reported in writing and will be handled within six weeks.

11.4 Applicable Law and Disputes

These terms and conditions are exclusively governed by Dutch law. Disputes will be submitted to the court in Paramaribo (Suriname) and the Netherlands (Den Haag)
